If you sell Gelato products in the EU or Northern Ireland, you’ll need to comply with the General Product Safety Regulation (GPSR) by December 13, 2024. These regulations introduce new requirements to enhance product safety and traceability.
If you are being asked by Amazon or other marketplaces about compliance with the GPSR, the following may guide your response.
Please note that this guidance is not legal advice. The product safety requirements discussed here may change over time. You should keep monitoring legal developments and seek professional consultation as needed.
What is GPSR?
The GPSR is an EU regulation aimed at ensuring products placed on the market are safe for consumers. It applies to all consumer products sold in the EU and Northern Ireland, including those marketed through online platforms.
Under GPSR, sellers are responsible for ensuring their products meet safety requirements, providing adequate warnings or instructions, and including traceability details (e.g., the manufacturer’s contact information).
What information do you need to supply?
The product information includes:
Manufacturer or responsible person in EU: This will be used for communication with authorities and end-customers.
Relevant Product Information: Include product identification, age restrictions, handling instructions, etc.
Safety and Warning Information: Applicable warnings and hazard information.
Who is the manufacturer or responsible person in the EU for the products?
If you are located in the EU, you’ll need to identify yourself as the manufacturer and provide your contact information.
If you’re located outside the EU:
Identify yourself as the manufacturer.
If you have not appointed your own responsible person in the EU, you can add the following as your EU responsible person:
Name: Gelato Estonia OÜ
Address: Rotermanni 6-2nd floor, 10111 Tallinn, Estonia
Email: [email protected]

What about product warranty and who should be responsible for this?
GPSR does not include an obligation for the manufacturer to provide or mention the legal guarantee on/with the products. However, the seller has a pre-contractual obligation to state this guarantee to consumers. For products sold in the EU, a 2-year warranty is mandatory.
It is a legal requirement for the seller (i.e. you) to provide this warranty in the EU. This means you must provide a refund or replacement within 2 years for faulty goods or goods that don't work as advertised. Between you and Gelato, you can get in touch with us within 30 days of receiving the item and we will do everything we can to investigate and find a solution.
