The following Guidelines apply to Gelato [Branded Labels and Packaging Inserts Services].

Gelato [Branded Labels and Packaging Inserts Services] are available to API Customers. Currently, Gelato will print the [Branded Labels and Packaging Inserts] for the Customers.

Customers using the Services shall observe the following guidelines and Gelato API Terms of Use.

[Branded Labels and Packaging Inserts Services] are subject to the following dimension specifications:-

Branded Label: 10.2x7.6 cm (4x3'').

Packaging Insert: 10.2x15.2 cm (4x6'').

[Branded Labels and Packaging Inserts Services] are available in the following countries/regions:-

For using [Branded Labels and Packaging Inserts Services], Customers will submit their own designs. Such designs constitute User Contents and are subject to the Gelato API Terms of Use.

All the contents submitted must comply with the applicable laws and regulations, must not infringe others’ intellectual property rights, and must not otherwise be offensive or inappropriate.

We advise that anything that resembles a barcode should be avoided as it can affect the internal process and handling of our carriers during delivery.

The [Branded Labels and Packaging Inserts] may contain words, phrases, images, graphics, etc. Such contents must not infringe on intellectual property rights, in particular trademarks and copyrights, of any third party.

The [Branded Labels and Packaging Inserts] must not contain inappropriate, obscene, immoral expressions, phrases, images, or graphics.

The [Branded Labels and Packaging Inserts] must not contain personally identifiable information, sensitive personal information, or confidential information without first obtaining appropriate consent from the persons involved or proper legal basis. Customers shall seek professional advice as to whether it is lawful for including such information in the [Branded Labels and Packaging Inserts] in the relevant countries.

Any Branded Labels and Packaging Inserts shall not contain any trademarks or brands of Gelato, or any messages indicating Customers are connected with Gelato, without the prior consent of Gelato.

If we consider the contents violate the law and Gelato API Terms of Use, we may take appropriate corrective actions, such as refusing to print the Branded Label and Packaging Insert, canceling the associated Order(s) (or any part of the Order(s)), and/or suspending your Accounts.

Customers are solely responsible for (i) handling any third-party claims alleging that the use of User Content, including our printing and shipment of Products following an Order, infringes a third party's intellectual property or other rights (including without limitation copyrights, trademarks, rights of publicity and rights of privacy); and (ii) handling any claims or investigations from government or authorities alleging that the User Content violates applicable law.

Pursuant to Gelato API Terms of Use, you shall indemnify and defend us against any losses, costs, liabilities, and expenses (including but not limited to damages, fines, and reasonable legal costs) incurred in connection with any claim or investigation of any kind made by any third party arising from or related to (a) an allegation that the use of the User Content infringes a third party's intellectual property or other rights (including without limitation copyrights, trademarks, rights of publicity, and rights of privacy)or violates applicable law, (b) you or anyone that you are responsible for use the Services in a manner not authorized by these Terms, or (c) any other breach by these Terms by you or anyone you are responsible for.

We will endeavor to fulfill all the Packaging Inserts and Branded Labels in accordance with your requirements in every order. However, we cannot guarantee every order will be fulfilled with the required Inserts and Labels. Gelato will arrange for refunds for missing/incorrect Packaging Inserts and Branded Labels, and you acknowledge and agree that Gelato will not be liable for further loss due to the missing/mistaken Packaging Inserts and Branded Labels.

We reserve the right to modify, suspend or discontinue the provision of the Services at any time with or without notice to you.
